Party Stems Terms and Conditions

2. Ordering Process

  • Once an order is placed, customers will receive an order confirmation email. Closer to the event date, customers will receive a processing update and confirmation of their pick-up/delivery details.

  • Custom Orders: We do not accept customisations. All products are available in the signature colour palettes and cannot be changed at the customer’s request.

 


 

3. Payment Terms

  • Accepted Payment Methods: Credit card (via Stripe).

  • Payment Due Date: Full payment is required at checkout.

  • Refunds for Cancellations: Orders can be cancelled up to 14 days before the event date and will receive a full refund minus a $25 processing/admin fee. Cancellations made within the 14-day window are non-refundable.

 


 

4. Shipping and Delivery

  • Delivery Areas: We currently deliver to Sydney Metro only.

  • Delivery Charges: A flat fee of $65 is applied for all orders.

  • Delivery Time Frames: Customers can choose a 2-hour delivery window during which their order will be delivered.

  • Missed Deliveries: If the customer is not at the specified location when the delivery is attempted, we will leave the order in a safe, shaded location at the delivery driver’s discretion. If no safe location is available, the order will be returned to our studio, and a $65 redelivery fee will apply.

  • Tracking Information: We do not provide tracking information for deliveries.

 


 

5. Returns and Refunds

  • Returns: We do not accept returns.

  • Damaged or Incorrect Items: If there is an issue with the florals upon delivery, we require photo evidence of any damage or fault within 2 hours of receiving the order. The issue will be assessed on a case-by-case basis.

  • Refunds: As per our cancellation policy, no refunds will be issued within 14 days of the event date. Customers are responsible for following care instructions once the flowers are delivered.

 


 

6. Privacy and Data Protection

  • Data Collection and Use: We collect customer data for order processing and marketing purposes.

  • Third-Party Data Processing: We use third parties like Shopify and Stripe for payment processing and website management.

  • Access and Deletion Rights: Customers may request to access or delete their personal data by contacting us at hello@partystems.com.au.

 


 

7. Product Descriptions and Accuracy

  • We take care to ensure that all product descriptions and images accurately represent the products. However, florals are selected by our florists according to the chosen colour palette, and the final product may differ from the images on our website due to seasonality and availability of flowers.

 


 

8. Out of Stock or Delayed Items

  • If an item is out of stock or cannot be fulfilled, we will notify the customer promptly and let them select an alternative product or choose a refund for the out of stock product.

 


 

9. Intellectual Property

  • All images, designs, and content on the Party Stems website are the property of Party Stems.

  • Use of Content: Customers are welcome to share images of Party Stems' products on social media, provided credit is given to Party Stems.

 


 

10. Liability Limitations

  • We are not liable for any damages or losses arising from the use or consumption of our products once they have been accepted by the customer. By accepting delivery, the customer assumes responsibility for proper care and handling of the flowers.

 


 

11. Disclaimers

  • Colour Variations: Due to screen settings and the seasonal nature of flowers, the actual product may vary slightly from the images on our website.

  • Florist’s Choice: All floral arrangements are made according to the chosen colour palette, but specific floral selections are at the discretion of our florists.

 


 

12. Customer Responsibilities

  • Customers must provide accurate information about their event and delivery details.

  • Customers are responsible for ensuring someone is available to receive their delivery. If picking up an order, customers must arrive within their selected time window.

  • Once the order is accepted, it is the customer’s responsibility to care for the flowers by following the care instructions provided.

 


 

13. Dispute Resolution

  • Any disputes should be directed to hello@partystems.com.au.

  • In case of unresolved disputes, the appropriate court in New South Wales, Australia will have jurisdiction.

 


 

14. Force Majeure

  • If an event is cancelled or rescheduled due to a force majeure (e.g., natural disasters, weather), we offer the following:

    • If the cancellation is outside the 14-day cancellation window, customers will receive a full refund minus a $25 processing/admin fee.

    • If the cancellation is within the 14-day window, customers will receive a credit note for a future order with Party Stems.
